Scope and acceptance

These terms govern the use of askwell, published by Flukx Studio. Creating an account or subscribing means you accept them.

Business customers only

askwell is sold only to businesses acting in a professional capacity. Consumer withdrawal rights therefore do not apply.

The service

askwell lets you build forms (by hand, from a template or from a description), follow up with AI on answers that are too vague, sum up each response in a card, and send responses to other tools through webhooks.

During the alpha, the service is free, provided as is, with no availability or backup guarantee, and may change at any time. AI use is capped each month, per account, at 500 responses read by Blob, 500 summary cards, 15 generated forms and 100 suggested A/B wordings.

Subscriptions and prices

No paid plan is open yet. Once paid plans open, prices will be shown on the Pricing page with no VAT: Flukx Studio is under the French VAT exemption for small businesses (VAT not applicable, art. 293 B of the French tax code), and subscriptions will be monthly or yearly, paid in advance by card through Stripe, renewing automatically.

Each plan's quotas (including responses read by Blob per month) will be described on the Pricing page. Any price change will be announced at least 30 days before it applies.

Cancellation

You can delete your account at any time from the settings.

Once paid plans open, you will be able to cancel your subscription from your account. Cancellation will take effect at the end of the current period; started periods will not be refunded.

Data and confidentiality

You keep ownership of your forms and the answers you collect. For those answers, Flukx Studio acts as a processor, under the commitments set out in the summary of the data processing agreement (DPA). The full agreement, being drafted, will be part of these terms.

Acceptable use

You may not use askwell to:

• impersonate anyone or collect credentials (phishing);
• send unsolicited messages;
• collect sensitive data without a legal basis;
• do anything unlawful.

Flukx Studio may suspend without notice any form or account that breaks these rules.

Anyone can report a form they consider unlawful or contrary to these rules through the “Report abuse” link at the bottom of every published form.

Artificial intelligence

Follow-ups, forms built from a description and summary cards are written by an AI model, which can make mistakes. You remain responsible for reviewing them and for how you use them. A notice at the top of the form tells respondents that Blob (AI) may ask them a question, and the note “Question added by Blob (AI)” appears under every follow-up.

Liability

Flukx Studio is bound by a best-efforts obligation. Its liability is capped at the amounts paid by the customer over the last 12 months and excludes indirect damages (lost revenue, data or customers).

Changes to these terms

Any material change is notified by email at least 30 days before it takes effect.

Governing law

These terms are governed by French law. Any dispute falls under the competent courts for Flukx Studio's place of business.
